Town of Montgomery

The Town Board adopted Resolution No. 17 of 2026, which authorizes the designation of the Colden Mansion Ruins property, acquired in 2008, as Town Parkland pursuant to New York State Town Law §220(3). The resolution mandates that the Town Parks Department take necessary steps to list the property as a Town Park. Furthermore, the Town Board stipulated that the park property shall be formally named within the next sixty (60) days. The resolution's adoption is subject to a permissive referendum, and the Town Clerk is directed to publish and post the notice of adoption.

The resolution authorizes the issuance of serial bonds to finance improvements to Sewer District Nos. 1 and 2, specifically for constructing a replacement wastewater pump station and new sewer mains. It details the determination of the project's cost, period of probable usefulness, and the pledge of the town's credit for bond repayment. The resolution also delegates powers to the Supervisor for issuing bond anticipation notes and selling the bonds, including the possibility of selling them to the New York State Environmental Facilities Corporation.

The maximum estimated cost is $1,500,000, with $750,000 allocated to each district. The board determined it is in the public interest to proceed with the project.

The Town Board authorized the Supervisor to accept bids for the sale of surplus real property located at 704 Neelytown Road and State Route 208. The highest bids identified were $10,000.00 and $15,000.00 respectively. The Supervisor is authorized to execute documents for property transfers, subject to Town Attorney approval. The resolution is subject to a permissive referendum, and the Town Clerk is directed to publish a notice of adoption.

The local law overrides the tax levy limit established in General Municipal Law Section 3-C for the fiscal year 2026. It authorizes the Town Board to adopt a budget for the fiscal year 2026 that requires a real property tax levy in excess of the limit specified in General Municipal Law, §3-c.
