Consulting Services for the Development of an Adequate Public Facilities/Concurrency Ordinance RFP

Description: York County is seeking proposals from qualified consulting firms to develop an “Adequate Public Facilities Ordinance” (APFO), also considered “concurrency” regulation. Development of the ordinance will include incorporating and updating existing concurrency elements in County code, establishing Levels of Service (LOS) across different public services, and design of an implementation program that aligns development timing with adequate public services and flexible mitigation options. York County is one of the oldest and fastest growing political jurisdictions in one of the oldest and fastest growing states in the country. It is situated at the northern extent of the South Carolina Piedmont region, with a land area of approximately 695 square miles and an estimated 2026 population of more than 311,000, making it the 7th largest of the state’s 46 counties. Through elements of its Land Development Code (LDC), York County has in place several elements that seek to ensure there are adequate public facilities in place that are sufficient to serve new development concurrent with its build-out, such as the requirement for Traffic Impact Analyses on area intersections and Willingness & Capability letters for water and sewer connections. York County now seeks to establish a more rigorous and detailed APFO and implementation program, to be fully integrated with the LDC. The new APFO will be informed by the County’s adopted goals in the Comprehensive and Strategic plans, capacity analyses, and the Capital Improvements Plan (CIP). The APFO should implement a methodical approach to growth management that still affords developers the opportunity to mitigate otherwise inadequate public facilities that would serve their projects.
