INTRODUCTION AND BACKGROUND The City of Houston, Alaska (the "City"), a second-class city organized under Title 29 of the Alaska Statutes and located within the Matanuska-Susitna Borough, invites qualified attorneys and law firms to submit proposals to provide City Attorney / municipal legal services. Houston is a growing community of approximately 2,100 residents situated along the George Parks Highway and the Little Susitna River, approximately 33 miles north of Anchorage. The City operates under a mayor-council form of government. The Mayor serves as the Chief Administrator pursuant to AS 29.20.220-.280 and Houston Municipal Code (HMC) Chapter 2.04. The City Council consists of seven members elected at-large; the Mayor and Deputy Mayor are selected annually by and from the Council. Pursuant to AS 29.20.360 and HMC provisions governing appointive officers (including HMC 2.16), the City Attorney is appointed by the Mayor and confirmed by the City Council and serves at the pleasure of the appointing authority. The duties of the municipal attorney are set forth in AS 29.20.370: "The municipal attorney is the legal advisor of the governing body, and the other officials of the municipality. The municipal attorney represents the municipality as attorney in civil and criminal proceedings. The school board may hire independent counsel when in its judgment independent counsel is needed." This Request for Proposals is issued consistent with the City's purchasing and contracting procedures under HMC Chapter 4.10 (Purchasing and Contracting), which defines professional services to include services provided by an attorney, and authorizes procurement by competitive sealed proposals under HMC 4.10.120 when qualifications and factors other than price are material to selection. The City has determined that competitive sealed proposals are the appropriate method because attorney qualifications, experience in Alaska municipal law, availability, and approach are primary considerations. The City of Houston, has determined that it's in our best interest to follow the recommendation from Alaska Municipal League and the State of Alaska, Department of Commerce, Community, and Economic Development, Division of Community and Regional Affairs (Local Government Resource Desk - Municipal Attorneys) recommends that municipalities publish notices requesting proposals for municipal attorney services and select counsel based primarily on qualifications and experience, with price as an important but secondary consideration. 3. Services include, but are not limited to: • General Municipal Law Advice.
