Serving as a consultant(s) to conduct a study of agency best practices regarding the availability, use, and management of discovery in agency adjudication. The study will support the development of a recommendation for action by federal agencies and, as appropriate, the president and/or congress. Discovery is an important tool for ensuring that parties to an adjudication have timely access to relevant, unprivileged information. When used effectively, discovery also promotes efficient decision making, encourages settlement between the parties, and ensures procedural fairness.

This project will examine the diversity of agency rules and practices for discovery in agency adjudications and produce recommendations to promote fairness, efficiency, accuracy, and timeliness across different types of proceedings. It will study availability and limits of discovery tools such as depositions and interrogatories, as well as adjudicator strategies and the use of technology to streamline discovery. The project aims to identify factors agencies should consider when selecting appropriate rules and practices for their specific proceedings.

Accepting proposals from individuals interested in serving as a consultant(s) to produce a report examining how agencies prevent, detect, and resolve improper payments in federally administered programs under which the federal government disburses funds directly to private individuals and organizations for their own use. The report will support the development of a recommendation for action by federal agencies.
