The Contractor will provide vehicles in sufficient number to effectively transport all students included in this contract. The contractor will also maintain sufficient numbers of spare vehicles to ensure continuous service without interruption. The vehicles shall have sufficient capacity to permit every student to be transported seated, and the maximum number of passengers carried in any vehicles will not exceed the legal seating capacity as established by the New York State Department of Transportation, Education, and all other agencies with jurisdiction. The number of students can be increased or decreased as long as it does not alter the number of vehicles being used. The contractor is allowed to use the vehicle to transport students from other school districts as long as the cost of the contract is prorated among participating districts. If the number of students decreases to zero (0), the contract can be terminated and payments prorated.
