Town of Pelham Council Regular Council Meeting
The council discussed a request for a development charge exemption for the Dere Fruit Farms property. The owner's representative argued that the farm market has operated for 40 years and that previous development charges were not collected when earlier additions were made, despite the property's residential zoning. The council deliberated on whether to retroactively apply development charges as the business attempts to bring its building into current code compliance. The council also explored the distinction between exempt agricultural buildings and retail-use buildings, noting that the property's historical change of use makes it a complex case.
