The council conducted an appeal hearing concerning the Planning Commission's approval of a project application to add 135 housing units to an existing apartment complex at 3831 Orchid Lane. The meeting featured presentations on the site plan review, scenic corridor permit, and oak tree permit requirements. Key discussion topics included the project's eligibility for density bonuses, environmental exemption analysis relative to the programmatic Environmental Impact Report, and significant concerns raised by the appellant regarding fire risks, the adequacy of evacuation routes, and compliance with state emergency response guidelines.
The commission discussed a proposed ordinance intended to serve as a stopgap measure to protect open space by requiring a 4/5 supermajority council approval for development activities on lands designated as Open Space, Recreational, or Public Facility. This interim measure is planned until a ballot measure can be presented to voters in 2028. Commissioners inquired about the definition of development, the potential risk of development applications during the interim period, and whether similar supermajority requirements should be applied at the commission level. Staff clarified that the ordinance includes specific definitions for development and exceptions for necessary maintenance, health, and safety activities.
The discussion focused on general changes and the consolidation of ordinances.
