District School Board of Niagara By-Law
The by-law pertains to the imposition of education development charges against land undergoing residential development within the District School Board of Niagara's jurisdiction. It outlines the conditions under which these charges are applied, including requirements for residential development that increase education land costs and necessitate actions identified in the Education Act. The by-law defines key terms such as 'education land costs,' 'dwelling unit,' and 'residential development,' and specifies the categories of development and land uses subject to these charges. It also details exemptions from these charges, including those for certain types of buildings like private schools and long-term care homes, as well as for specific organizations like colleges and universities. Furthermore, the by-law establishes the rates for education development charges per dwelling unit for the period from December 7, 2025, to December 6, 2030, and includes provisions for the payment, administration, and collection of these charges.
