Subdivision and Development Appeal Board Board Decision
The board heard an appeal regarding a Stop Order issued for exterior lighting at 477 Stewart Creek Close due to non-compliance with lighting regulations. The appellant argued against the Stop Order based on procedural grounds and compliance with certain technical standards. The board ultimately denied the appeal and upheld the Stop Order, finding that the lighting fixtures lacked necessary glare control, caused light trespass on adjacent properties, and were mounted in a way that permitted light to project above the horizontal plane, failing to minimize glare as required by local bylaws. The condition requiring a development permit application was deleted from the original order.
