AvailableThis Data Privacy Agreement (DPA) between Albany-Schoharie-Schenectady-Saratoga BOCES (EA) and ClickView (Contractor) establishes terms for the privacy and security of Personally Identifiable Information (PII) handled by ClickView while providing services under a separate Service Agreement. Key provisions include compliance with state and federal data privacy laws (FERPA, COPPA, PPRA, IDEA, NY Education Law 2-d), restrictions on PII use (only for authorized services, no commercial/marketing use), requirements for data security safeguards aligned with the NIST Cybersecurity Framework, obligations regarding subcontractors, procedures for data return and secure destruction upon contract termination, and protocols for handling data breaches including prompt notification to the EA. The DPA also addresses parent and eligible student rights regarding access to student data and incorporates the Parents Bill of Rights for Data Privacy and Security.
